PROVISIONS FOR PURCHASE ORDERS

Purchase Orders are generally issued for the purchase of goods, equipment, and supplies.  The Seller is required to adhere to SMART’s Standard Terms and Conditions.

 

Special Conditions for Federally Funded Purchase Orders:
SMART is a recipient of Federal funds.  When Federal funds are used to fund a purchase order, the seller must comply with all applicable federal contract provisions as established by various laws and regulations.  The requirements for the provisions vary depending on the type and size of the procurement action.  SMART will inform Seller if Federal funds will be utilized to fund the purchase.  Seller is required to adhere to SMART’s Standard Terms and Conditions with Federal Requirements for all Federal procurements.

 

TRAVEL GUIDELINES FOR SMART CONTRACTORS

Occaisionally, SMART contracts may authorize the reimbursement of travel costs. When authorized by contract, the terms and conditions of the contract and SMART’s Travel Guidelines for SMART Contractors will apply.  These travel guidelines are updated each calendar year (January 1 – December 31).  Below are the Travel Guidelines for SMART Contractors for reference:

CALIFORNIA UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT (CUPCCAA)

 

The Sonoma-Marin Area Rail Transit District (SMART) adopted the California Uniform Public Construction Cost Accounting Act.  Pursuant to Public Contracts Code Section §22000 et seq, SMART is compiling its Informal Bidder's List for Fiscal Year 2025 (July 1, 2024 - June 30, 2025) for construction of public projects as specified in the Public Contracts Code §22032.  Contractors interested in being included on SMART's Informal Bidder's List must complete and submit the Informal Bidder's List Registration Application for the Fiscal Year that they are interested in.

SURPLUS AUCTION SITE

 

The Sonoma-Marin Area Rail Transit District (SMART) partners with GovDeals to auction materials, equipment, and other supplies which are no longer necessary for the operation of SMART.  These items may be designated as surplus, obsolete, scrap, or have reached the end of their useful life.

BUSINESS OUTREACH COMMITTEE:

The Sonoma-Marin Area Rail Transit District (SMART) is an active partner of the Business Outreach Committee (BOC) comprised of over 26 Bay Area Transit Agencies.  The Business Outreach Committee (BOC) hosts several events throughout the year to assist and encourage Small Business Enterprises (SBEs) and Disadvantaged Business Enterprises (DBEs) to do business with government agencies.

Sonoma-Marin Area Rail Transit District (SMART) is dedicated to ensuring full and open competition and equitable treatment of all potential bidders/proposers. NOTICE OF CONTRACTOR AND GRANTEE COMPLIANCE WITH ECONOMIC SANCTIONS IMPOSED IN RESPONSE TO RUSSIA'S ACTIONS IN UKRAINE

 

To All Contractors, Vendors, Suppliers, and Consultants:

On March 4, 2022, Governor Gavin Newsom issued Executive Order N-6-22 (EO) regarding sanctions in response to Russian aggression in Ukraine. The EO is located at https://www.gov.ca.gov/wp-content/uploads/2022/03/3.4.22-Russia-Ukraine-Executive-Order.pdf.  The EO directs all agencies and departments that are subject to the Governor’s authority to take certain immediate steps, including notifying all contractors, vendors and grantees of their obligations to comply with existing economic sanctions imposed by the U.S. government in response to Russia's actions in Ukraine, as well as any sanctions imposed under state law.  ​This serves as a notice under the EO that as a contractor, vendor, supplier, consultant, or grantee, compliance with the economic sanctions imposed in response to Russia’s actions in Ukraine is required, including with respect to, but not limited to, the federal executive orders identified in the EO and the sanctions identified on the U.S. Department of the Treasury website (https://home.treasury.gov/policy-issues/financial-sanctions/sanctions-programs-and-country-information/ukraine-russia-related-sanctions). Failure to comply may result in the termination of contracts, purchase orders, or grants, as applicable.

The Sonoma-Marin Area Rail Transit District (SMART) has an established procurement ethics and standards of conduct policy for all SMART Board Members, employees, officers, and agents involved in the planning, evaluation, selection, award, and contract administration of all goods and services purchased by the District.
